1. Who may purchase and use BabyMilu
BabyMilu is strictly intended for adults aged 18 or older. You must be at least 18 years old to purchase, register for, access, or use a BabyMilu device or any connected BabyMilu service.
By completing this purchase, you represent and warrant that:
- You are at least 18 years old;
- You are purchasing the device for use only by adults aged 18 or older; and
- You will not knowingly allow a minor to create or use a BabyMilu account or access BabyMilu’s connected services.
BabyMilu is not designed for, directed to, or intended for use by minors. If you allow another person to access your device or account, you are responsible for ensuring that the person is at least 18 years old and complies with the applicable terms. We may suspend or terminate an account if we reasonably believe it is being used by a person under 18.
2. Status of the hardware project
The BabyMilu hardware project has been paused indefinitely.
This purchase is for an existing manufactured device from that paused project. It is not a purchase from an actively developing or continuously supported hardware product line.
Continued hardware development, new hardware production, new features, software updates, firmware updates, maintenance, repairs, replacement inventory, and individualized technical support are not guaranteed except for the limited remedy expressly described in Section 7.
3. Connected-service requirements and limitations
Core BabyMilu functions require:
- A compatible device (most fold phones are known to be incompatible);
- The BabyMilu app;
- A BabyMilu account;
- A stable internet connection.
Please do not purchase if your household Wi-Fi is captive Wi-Fi or does not support 2.4 GHz.
Cloud services may be interrupted, degraded, modified, restricted, or discontinued. If the app or cloud services are changed or discontinued, some or all connected features of the device may stop working.
We do not guarantee:
- Uninterrupted or error-free service;
- Any particular level of uptime;
- Continued availability for a particular period;
- Continued compatibility with future phones or operating systems;
- New features or improvements;
- Ongoing software or firmware updates;
- Routine repairs or replacement parts; or
- Individualized or continuous customer support.
The disclosed status of the paused project, the absence of future updates or support, and the later modification or discontinuation of connected services will not, by themselves, be treated as product defects.
4. Pricing and server-cost statement
The purchase price reflects our current estimate of the hardware cost and the anticipated cost of operating the existing service for approximately one year. This pricing explanation is not a guarantee that the service will remain available for any particular period.
5. Shipping
BabyMilu devices purchased through this offer are available for shipping within the United States only.
US only. Orders are expected to ship in July 2026. Shipping dates are estimates and are not guaranteed. Shipping is a flat $10.
If we are unable to ship or deliver your device, we will cancel the order and refund the amount you paid, including the original shipping charge.
You are responsible for providing a complete and accurate shipping address. Contact us promptly if your address needs to be changed before shipment.
6. Cancellation and final sale
You may cancel your order for a full refund at any time before it ships by contacting contact@babymilu.com.
Except for cancellation before shipment, the limited remedy for qualifying defective or damaged devices described below, and rights that cannot legally be waived, all sales are final.
Because this is a limited-support device from a paused hardware project, we do not accept returns or provide refunds for change of mind, dissatisfaction with disclosed limitations, or future discontinuation of online services, except where required by law.
The final-sale restriction does not apply to non-delivery, qualifying shipping damage, or material nonconformity.
We do not accept returns or provide refunds based solely on:
- A change of mind;
- Buyer’s remorse;
- Dissatisfaction with limitations clearly disclosed before purchase;
- Cosmetic variations that do not materially interfere with ordinary use;
- The absence of future features, updates, repairs, or support that were not expressly promised;
- Interruption, modification, degradation, or future discontinuation of connected services; or
- Incompatibility caused by future changes to third-party hardware, operating systems, networks, or services outside our reasonable control.
Nothing in these terms eliminates consumer rights that cannot legally be waived.
7. Defective or damaged devices
If your device arrives materially damaged or cannot power on or complete initial setup, contact us at contact@babymilu.com within 14 days after delivery. After reasonable troubleshooting and verification, we may, at our option, provide a replacement unit while inventory remains available or refund the purchase price. This does not cover cosmetic variation, ordinary wear, misuse, accidental damage, connectivity issues outside our control, or the disclosed limitations of the paused hardware project and cloud service.
Shipping damage is included in “arrives materially damaged.” A device that materially differs from its product description is eligible for the same limited remedy if reported to contact@babymilu.com within 14 days after delivery.
8. Existing condition and variations
These are existing manufactured BabyMilu units from a paused hardware project.
Minor variations in fabric, stitching, alignment, texture, coloring, firmness, or other cosmetic characteristics may occur. Such variations are not defects unless they materially prevent the device from performing its ordinary physical function.
This section does not excuse safety issues, undisclosed shipping damage, non-functioning hardware, non-delivery, or a device that materially differs from its product description.
9. Previous BabyMilu purchases
This purchase is separate from any previous BabyMilu preorder, beta purchase, vending-machine purchase, or other transaction that was refunded.
Receiving a refund for a prior purchase does not reserve a unit, reinstate the prior order, or transfer the prior payment to this purchase.
By placing this order, you are making a new and independent purchasing decision after receiving the disclosures in these terms.
10. Research participation
Purchasing or using BabyMilu does not enroll you in any research study or authorize the use of your information for a specific research project.
Any future research or testing opportunity will be:
- Optional;
- Presented separately;
- Subject to its own eligibility criteria;
- Accompanied by separate information and consent; and
- Unnecessary to purchase or ordinarily use BabyMilu.
11. Terms governing the app and connected services
Your use of the BabyMilu app, account, AI companion, and cloud services is separately governed by our current Terms of Service.
These Limited-Support Device Purchase Terms govern this particular hardware purchase. If these Purchase Terms conflict with the Terms of Service concerning the price, shipping, cancellation, final-sale status, or limited defect remedy for this device, these Purchase Terms control for those subjects.
The Terms of Service continue to govern use of the app, account, AI-generated content, cloud services, acceptable use, intellectual property, dispute resolution, and other software-related matters.
12. Privacy
Information collected in connection with your purchase and use of BabyMilu is handled as described in our Privacy Policy.
The Privacy Policy is separate from these Purchase Terms and is not reproduced here. A link to it remains visible at checkout and should be included in the order confirmation.
Purchasing a device does not constitute consent to participate in research. Any consent required for optional data uses, marketing, or research must be obtained separately where applicable.
